By accessing or using the website, applications, tools, features, content, and services offered by Macknified LLC, doing business as Macknified AI ("Macknified AI," "Macknified," "we," "our," or "us"), you agree to be bound by these Terms of Service and our Privacy Policy.
If you disagree with any part of these Terms, you may not access or use the Services.
Macknified AI offers a subscription-based service that may include a 7-day free trial. After the trial period, your payment method will be charged the applicable subscription fee unless you cancel before the trial ends.
You are responsible for all charges incurred under your account. We use Stripe or other authorized payment processors and do not intentionally store complete payment card information on our servers.
Subscription fees are non-refundable except where required by applicable law. You may cancel your subscription at any time, and you will continue to have access to the Services through the end of your current billing period.
All pricing, plans, features, and usage limits are subject to change at the sole discretion of Macknified LLC. Continued use of the Services after a pricing or plan change becomes effective constitutes acceptance of the updated pricing or plan terms.
AI agent accounts that exceed 1,000 messages per calendar month may be subject to additional usage-based charges.
You must register for an account to use certain Services. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You must promptly notify us at support@macknified.com if you believe your account has been accessed without authorization.
You agree not to use Macknified AI for any illegal, harmful, fraudulent, or unauthorized purpose. You agree not to use the Services to:
If you use the Services to collect, process, store, transmit, or manage personal data belonging to customers, leads, users, employees, or other end users, you acknowledge and agree that:
Depending on the nature of the Services and applicable law, you may act as a controller, business, covered entity, or other regulated party, and Macknified LLC may act as a processor, service provider, vendor, or other service provider.
Macknified LLC d/b/a Macknified AI is not designed, configured, or authorized for HIPAA-regulated use and does not offer HIPAA-enabled services or Business Associate Agreements.
You must not use the Services to collect, store, transmit, process, display, analyze, disclose, or otherwise handle Protected Health Information ("PHI"), electronic Protected Health Information ("ePHI"), medical records, therapy notes, clinical intake information, diagnoses, treatment information, medication information, insurance information, identifiable mental-health assessments, behavioral-health records, patient records, or other regulated health information.
You are solely responsible for determining whether HIPAA, the HITECH Act, state health-privacy laws, professional licensing rules, consumer-protection laws, or other legal requirements apply to your business, forms, communications, workflows, and data practices.
You must use a separate, appropriately configured HIPAA-capable platform for clinical intake, therapy records, patient communications, patient portals, medical forms, or other workflow involving PHI or ePHI.
Macknified LLC may suspend, disable, restrict, remove, or investigate any account, form, automation, workflow, integration, content, or feature that Macknified LLC reasonably believes is being used to collect, transmit, store, or process regulated health information through the Services.
Macknified LLC does not provide legal, medical, healthcare-compliance, HIPAA-certification, or regulatory advice. You are responsible for obtaining independent legal and compliance guidance as needed.
Macknified AI and its content, features, functionality, software, branding, logos, designs, and underlying technology are owned by or licensed to Macknified LLC and are protected by applicable copyright, trademark, patent, trade-secret, and other intellectual-property laws.
Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or exploit any portion of the Services without prior written permission.
You retain ownership of any content you create, upload, submit, connect, generate, or share through Macknified AI ("User Content").
By providing User Content, you grant Macknified LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, process, transmit, display, and use User Content only as reasonably necessary to provide, maintain, secure, support, and improve the Services.
You represent and warrant that you have all necessary rights, permissions, and lawful authority to submit User Content and grant this license.
Macknified LLC may terminate, suspend, restrict, or disable your account and access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, created legal or security risk, failed to pay amounts due, or used the Services in a manner that may harm Macknified LLC, other users, or third parties.
You may terminate your account at any time by contacting us or using the account-deletion feature in your settings.
Upon termination, your right to use the Services will immediately cease. We may delete or anonymize account data and User Content in accordance with our Privacy Policy, legal obligations, security requirements, and backup-retention practices.
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Macknified LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and uninterrupted operation.
Macknified LLC does not guarantee that the Services will be error-free, uninterrupted, secure, available at all times, or suitable for your specific business, legal, marketing, healthcare, financial, or compliance needs.
To the maximum extent permitted by law, Macknified LLC, its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, inability to use, or reliance on the Services.
To the maximum extent permitted by law, Macknified LLC's total liability for all claims arising from or related to the Services will not exceed the amount you paid Macknified LLC for the Services during the three months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, Macknified LLC's liability will be limited to the maximum extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless Macknified LLC, its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, demands, actions, damages, losses, liabilities, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
When you connect a Google account, including Google Calendar, Sheets, Docs, Drive, or Gmail, Macknified LLC handles data received from Google APIs in accordance with the Google API Services User Data Policy and applicable Limited Use requirements.
We do not use Google User Data to train generalized AI models, do not sell it, and do not transfer it to advertisers. Widgets that read from Google APIs are technically restricted from being served by our DeepSeek platform fallback.

The Services may provide SMS messaging capabilities using a shared phone number or customer-connected phone numbers.
Each account may receive a limited number of free platform SMS messages per month. After free messages are exhausted, additional SMS credit packs may be purchased. SMS credits are non-refundable, and paid credits do not expire. Free monthly credits reset at the beginning of each calendar month, and unused free credits do not roll over.
Users who connect their own Twilio credentials and phone numbers are not subject to Macknified AI platform SMS metering or charges.
Platform SMS is provided on a best-effort basis. Macknified LLC does not guarantee message delivery, and standard carrier messaging or data rates may apply to recipients.
You are solely responsible for obtaining all legally required consents and complying with all applicable laws governing SMS, calls, marketing messages, opt-outs, and consumer communications.
We may modify these Terms from time to time. We may provide notice of material changes by email, through the Services, or by posting the revised Terms with an updated "Last updated" date.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
These Terms are governed by the laws of the State of South Carolina and applicable federal laws of the United States, without regard to conflict-of-law principles.
Before initiating formal legal action, you and Macknified LLC agree to attempt in good faith to resolve any dispute informally by contacting the other party and allowing a reasonable opportunity to resolve the matter.
If a dispute cannot be resolved informally, it will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where applicable law prohibits mandatory arbitration.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to prevent unauthorized use, misuse, infringement, security harm, or unlawful disclosure of confidential information.
